As a university with a substantial population of international students, BYU–Hawaii is obligated to comply with a wide variety of laws affecting international travel; international student and visitor regulations; and international research, trade, and communications. Immigration regulations impact students, faculty, other employees, and study abroad groups. Additionally, the laws in foreign jurisdictions apply to partnerships with foreign universities. The university must closely follow a variety of federal regulations including those developed by the Department of Homeland Security and the Department of State.
Disability law is generally enforced through federal and state equal opportunity agencies. Unlawful discriminatory action by the university may result both in litigation against the university and possible loss of federal financial assistance. Because of extensive legal regulations designed to assist persons with disabilities, and heightened public sensitivity to barriers faced by persons with disabilities, it is important that the campus community be informed of its responsibilities under applicable disability laws.
Brigham Young University–Hawaii prohibits unlawful discrimination in employment, education, and all programs and activities sponsored by the university. This prohibition applies to acts of unlawful discrimination by or against university employees, students, and campus visitors-including applicants for employment or admission, and it includes unlawful discrimination on the basis of disability.
BYU–Hawaii is subject to numerous laws due to its participation in federal student aid programs, also known as Title IV programs (because they are described and administered under Title IV of the Higher Education Act). Additionally, the law governs the administration and disbursement of financial aid at the university. Every six years, the university enters into a program participation agreement—signed by the president—that conditions the receipt of funds on compliance with a variety of federal laws.
