Student Conduct

i. All institutions of higher education that receive federal funds must take specific steps to prevent and address drug and alcohol abuse on their campuses among students and employees. Two statutes that stipulate such measures are the Drug-Free Schools and Communities Act of 1986 and the Drug-Free Workplace Act of 1988. Generally, these laws and subsequent amendments require that an institution of higher education adopt and implement a drug prevention program.

Compliance with these acts is demonstrated at Brigham Young University–Hawaii in the implementation and enforcement of the CES Honor Code, the Drug-Free School Policy and the Drug-Free Workplace Policy.

A multitude of state and federal laws prohibit unfair discrimination and require that people be treated fairly and without regard to race, color, national origin, ethnicity, religion, age, sex, marital status, disability, sexual orientation, gender identity, or genetic information. Some laws require affirmative action to advance and assist those within legally protected classes, while others simply seek to provide equal opportunities and appropriate accommodations. Historically, discrimination laws have focused on employment, housing, education programs, federal programs, and places of public accommodation.

Federal laws have long prohibited sex discrimination and sexual harassment in employment and education programs, but a growing concern over the high incidence of campus sexual assault has brought greater attention and regulation of sexual assault as a type of sexual harassment. In fact, compliance with Title IX of the Education Amendments of 1972 has been complicated by new laws and extensive and evolving regulatory guidance. The Violence Against Women Reauthorization Act of 2013 imposed new requirements for institutional policies and procedures related to responding to allegations of sexual assault and other sex-based crimes. Additionally, many colleges and universities are facing lawsuits and government investigations arising from allegations of indifference or inappropriate handling of complaints of sexual misconduct.
